01Operator and scope
BENHERAZE 3D supplies 3D design/modelling, technical preparation, 3D printing, prototypes and small runs from Beja. The seller and service provider is the operator identified at the start of this page. These terms supplement each proposal; mandatory law prevails, followed by the accepted specific terms.
02Request and contract
Submitting a form is free, creates no order and carries no payment obligation. After review, we may request more information, decline the work or issue a proposal specifying scope, revisions, material, quantity, finish, tax, delivery, timing, validity and total. A contract forms when the customer expressly accepts the proposal with an obligation to pay; work may start only after payment and the required information are confirmed.
03Customer information and supplied models
The customer must provide accurate known measurements, units, interfaces, quantities, intended use, environment and special requirements, and must be authorised to use submitted files, drawings, brands and references. BENHERAZE 3D is responsible for using those elements correctly and for the manufacturing review included in the proposal. A production preflight is not a complete validation or certification of a customer-designed model unless expressly included. If we identify a relevant inconsistency or missing decision, we pause and ask rather than knowingly proceed on an assumption.
04Modelling by BENHERAZE 3D
When we create the model, the proposal defines the brief, source information, deliverables, included revisions, formats, rights and intended validation. We share a review version before manufacture. The customer checks facts and preferences that depend on their context—such as names, supplied measurements, mating objects and appearance—while we remain responsible for the modelling work we perform and for correcting errors within the agreed scope.
05Approval and changes
Model approval confirms the version that was reviewed; proposal acceptance confirms the production specification, including material, physical colour, finish, quantity, tolerances, intended use, price and timing where applicable. Approval does not waive mandatory rights or excuse our errors. If a requirement changes, we assess it before the affected work continues and explain any effect on price or timing in advance. A deviation from objective conformity requirements is effective only where the law allows and the consumer has been specifically informed and has accepted it separately, expressly and unequivocally.
06Files, rights and prohibited uses
The customer warrants the right to use and reproduce files, brands and references. We decline weapons, unlawful purposes, rights infringement and critical applications without adequate specification and validation. Customer files remain theirs; rights in designs we create are stated in the proposal. Nothing is published without permission.
07Technical limitations
FDM produces layer lines and permissible variation in colour, texture, orientation and tolerance. Load, impact, heat, UV, moisture, chemicals, fatigue, food contact and certification must be disclosed. A prototype is not automatically a certified or safety-critical part. Special testing and tolerances must be agreed.
08Price, payment, timing and delivery
Price reflects material, machine time, setup, supports, risk, finishing, modelling, quantity, packing and shipping. Total, VAT and carriage appear before acceptance. Production, service-performance and delivery timings are defined individually for each project and communicated before the customer confirms the order. The proposal separates BENHERAZE 3D work from the carrier estimate for physical shipping and identifies digital delivery where there is no dispatch.
09Consumers, businesses and conformity
Portuguese consumer conformity rules apply to a natural person acting mainly outside a commercial, industrial, craft or professional activity, including goods made or produced to order. For those sales, the statutory liability period for movable consumer goods is generally three years. Business purchases are governed by the accepted proposal and applicable general law; consumer-only remedies are not described as a B2B commercial guarantee. Mandatory law always prevails.
10What is a lack of conformity
Assessment compares the delivered work with the accepted description, type, quantity, quality, agreed particular purpose, accessories and instructions, sample or model, and the durability, functionality and safety reasonably expected by law. Examples may include the wrong version, material, physical colour or quantity, a dimension outside an agreed tolerance, delivery damage, or workmanship or performance that does not match the contract. Applicable consumer remedies may include repair, replacement, price reduction or termination under the statutory conditions.
11What is normally a different cause
A problem caused solely after delivery by misuse, accidental damage, unsuitable storage, unauthorised alteration or use outside the disclosed and agreed purpose is normally different from a lack of conformity existing at delivery. A later change of mind or dislike of an expressly approved design, physical colour, finish or specification that was correctly produced is also not, by itself, a manufacturing defect; any applicable withdrawal right is a separate question. We assess the evidence and cause in each case and do not use this distinction to exclude mandatory rights.
12Liability and disputes
We do not limit rights or liability that law does not permit us to exclude. BENHERAZE 3D remains responsible for the modelling, preparation, manufacturing, inspection, information and delivery obligations it actually undertakes. Portuguese law applies without removing mandatory protection in the consumer’s country of residence. Complaint, ADR and court channels remain available.
